General Terms and Conditions

These General Terms and Conditions (the "Terms") are provided by SPORTS FAN ENTERTAINMENT MEDYA TICARET A.S. (the "Company") to inform you about the website with the star.fan extension (the "Platform").

By registering on the Platform, you are deemed to have accepted the Terms below without any limitation or restriction. If members do not accept and approve these Terms, they must not continue to use the Platform. Continued use of the Platform means that these Terms have been accepted.

The Company has the right to unilaterally amend the Terms on this page at any time without prior notice. Changes will be notified to members by e-mail to the e-mail address registered on the Platform and/or by SMS to their phones.

All products on the Platform are original licensed products and are under the responsibility of their manufacturers or importers. The Company has no responsibility for the quality, characteristics or features of these products.

Right to Make Changes on the Platform

Starfan reserves the right, unilaterally and without prior notice or reason, to change all services offered on the Platform, these Terms and any information provided on the Platform, to reorganize and redesign the Platform, to suspend its publication or to remove the Platform. Access to the Platform constitutes acceptance of such possible changes. Starfan accepts no liability for interruptions, defects, omissions, deletions, losses, delays in processing or communication, viruses, communication errors, theft, destruction, unauthorized access to records, modification or use of records arising from any breach of the Terms, tort, negligence or other reasons, and cannot be held responsible for damages that may arise from such changes. Members are deemed to have accepted changes by continuing to use the Platform after such software or changes are announced.

Intellectual Property Rights

All content, software, designs, visuals and texts on the Platform are the property of Starfan. All visual and written materials on the Platform, including the sales system, business method and business model applied, are owned by Starfan and are protected under Law No. 5846 on Intellectual and Artistic Works, Law No. 6769 on Industrial Property, applicable Turkish legislation and international copyright rules. Members may not copy, reproduce, modify or distribute any content for commercial or personal purposes without Starfan's express written permission. It is prohibited to copy, modify, publish or distribute, in whole or in part, any information on the Platform or any database, software or visual material related to the Platform for commercial or personal purposes without prior permission. If such use is detected, Starfan reserves all legal and criminal application rights.

User Account

To use certain features of the Platform, the member must register on the Platform and provide the information requested in the registration form. The member represents and undertakes that all required registration information submitted is reliable and accurate and will remain accurate, and that the member's use of the application does not violate any applicable legislation or these Terms.

The member is responsible for maintaining the confidentiality of login information for the account held within the Platform. The member is responsible for all activities associated with the account, including purchases and Platform use. All damages arising from unauthorized use of the account belong to the user. If unauthorized use of the Platform or the user's account occurs, the member must immediately notify Starfan. Upon such notification, Starfan may suspend or otherwise secure the member's Platform account to prevent further unauthorized use. Starfan reserves the right to suspend or block access to the Platform completely or temporarily in case of suspected unauthorized use or notifications made by members.

The necessary measures for the security of information and transactions entered by the member on the Platform are taken within Starfan's system infrastructure to the extent technically possible according to the nature of the information and transaction. Because such information is entered from the member's own device, the responsibility for protecting the information on the member's side and preventing access by unrelated persons, including measures against viruses and similar harmful applications, belongs to the member.

Use of the Platform

The Platform may not be used to transmit or forward materials that constitute a violation; are threatening, false, misleading, abusive, defamatory, libelous, obscene, indecent, provocative, pornographic or profane; or that constitute or encourage an act giving rise to criminal or civil liability or otherwise violating any legislation. Likewise, the member may not use another person's personal information such as IP address, e-mail address or username on the internet, and may not access or use other users' private information without permission. The member is deemed to accept all legal and criminal liability arising from such use. If such use is detected, Starfan has the right to close the user account and initiate necessary legal proceedings.

While using the Platform and its services, the member agrees to comply with the KVKK, Turkish Penal Code, Turkish Commercial Code, Law on Intellectual and Artistic Works, Industrial Property Law, laws, regulations and decrees concerning the protection of trademark, design and patent rights, the Code of Obligations, all other relevant legislation, and all announcements and notifications published on the Platform. All legal, criminal and financial liability arising from use contrary to these notifications and laws belongs to the member.

All intellectual and industrial rights and property rights concerning all information and content on the Platform, their arrangement, revision and partial or complete use, belong to Starfan, except those belonging to third parties under Starfan's agreements.

The member agrees, represents and undertakes not to use software that threatens the security of the Platform or prevents the operation of the Platform and the software used, not to take actions that prevent or make difficult the use of the Platform by other users and visitors, not to overload or lock servers or databases by installing automated programs, and not to attempt fraud. If such activities are carried out or attempted, or if information is obtained, deleted or changed, the member's membership will be terminated and the member will be responsible for resulting damages.

Relations between Platform users or with third parties are the responsibility of those persons. The Platform may include links to websites and/or content owned and operated by third parties that are not under the control of the Platform. These links do not support any website or the person operating it and do not constitute any representation or warranty regarding the information contained on such websites. Starfan has no responsibility for websites or content accessed through links on the Platform, and any damages arising from their use are the responsibility of the member. Starfan may make access to such linked websites subject to its written consent and may at any time cut access to links it does not deem appropriate.

The member is directly responsible for all damages arising from sharing usernames, passwords or similar information and usage rights given to or determined by the member with third persons or organizations. Starfan reserves all rights to claim compensation and other remedies against any responsibility or claims that may be asserted against Starfan by third parties or authorized authorities for this reason.

Different rules and obligations may be stated in certain parts of the Platform. If the member uses those sections in line with the information provided, the member is deemed to have accepted the rules stated in that section.

Membership cancellation and account deletion may be carried out by the member by applying through the Platform.

Limitation of Liability

Starfan makes maximum effort to keep the information on the Platform current and valid. Starfan reserves the right to make changes to data and products on the Platform without prior notice.

Starfan does not guarantee that the content offered through the Platform will be uninterrupted or error-free. Starfan is not responsible for any direct or indirect damages that may arise from access to the Platform or use of the Platform or information and other data on the Platform due to any breach of the Terms, tort or other reasons. Starfan accepts no liability if a transaction carried out through the Platform is interrupted or if errors or omissions occur due to any breach of the Terms, tort, negligence or other reasons. All risks arising from users' use of the Platform belong to them. Starfan will not be responsible for any risk, liability, court expenses or other damages arising from use of the Platform.

Starfan cannot be held responsible to members for problems that may arise from typographical errors concerning product/service names, product/service prices or product/service terms and conditions.

Applicable Law and Competent Court

For disputes that may arise from these Terms and use of the Platform, the provisions of these Terms will apply first; where these Terms contain no provision, the laws of the Republic of Turkey will apply. Istanbul Anatolian Courts and Enforcement Offices will have jurisdiction over all disputes arising from or connected with these Terms and use of the Platform.

Confidentiality

During and after the term of these Terms, the parties may not disclose to third parties, use for the benefit of other persons, institutions or organizations, or cause others to use any information and documents communicated to them in writing, orally or otherwise ("Confidential Information"), without the written consent of the other party, except where permitted by applicable legislation. The parties are obliged to ensure the confidentiality of the Confidential Information, take all necessary measures, act in accordance with confidentiality principles, prevent unauthorized use of such information and protect it from misuse.

The ownership rights to all criticism submitted to the Platform belong to Starfan and may be used by Starfan for marketing purposes if desired.

Protection of Personal Data

Starfan respects and attaches great importance to the confidentiality of members' personal information. Accordingly, collection and use of personal data within the Platform are kept to a minimum, and the collected personal data is used to carry out transactions.

Termination of Platform Use and Membership

If the member acts contrary to applicable legislation or these Terms, Starfan may, at its sole discretion, review, suspend, freeze or terminate the member's personal account, membership records or similar uses on the Platform at any time. Payment obligations for orders placed before termination of the member's account continue. If the account is terminated, the member will have no account or similar membership right on the Platform. The limitations of liability and miscellaneous provisions under these Terms will continue to be valid after such termination. Starfan may send notice of account termination through the contact information provided by the member through the Platform. No right to compensation arises for the person in this process.

The member agrees to compensate Starfan in kind for all damages suffered by Starfan due to the member's breach of obligations under this Agreement. Starfan has a right of recourse against the member for any compensation and/or administrative/judicial fines it may have to pay to public institutions and/or third parties due to the member's conduct contrary to the Agreement.
